Contest Rules
The GateGuru High Flyers Contest (the “Contest”) is sponsored by Mobility Apps, LLC (“GateGuru”). Apple is not a sponsor of, or responsible for conducting, the Contest. The Official Rules consist of the terms and conditions set forth below, as well as the Privacy Policy and Terms of Service set forth on www.gateguruapp.com (collectively, the “Rules”). You agree that by participating in the Contest, you are bound by these Rules. GateGuru reserves the right to revise or change these Rules at any time and without notice to you by posting updated text on www.gateguruapp.com. You are responsible for periodically visiting www.gateguruapp.com to view any changes. If we update our Rules, any changes will apply to the Contest, even if you enroll before such updated text is posted. In these Rules, the terms “you, your, and yours” refer to the Contest applicant, the terms “we and us” refer to GateGuru, and the term “Points” refers to your High Flyers Points.
CONTEST RULES:
1. Eligibility: The Contest is open to all individuals who are legal residents of the fifty (50) United States and DC eighteen (18) years of age or older at the time of entry. Employees, officers and directors of JetBlue Airways Corporation (“JetBlue”) and GateGuru and their respective affiliates, associates and immediate family members and persons with whom such employees are domiciled are not eligible to participate in this Contest. To be eligible for the Contest, users must be on GateGuru version 1.5.
2. Entry Periods: The Contest begins on August 1, 2010 (12:01 AM ET) and ends on August 31, 2010 (11:59 PM ET).
3. How to Enter: Users of the GateGuru mobile application can enter the Contest. By earning points within the GateGuru application, users are entered into the Contest. Users can see how to accumulate points within the Info button on the High Flyers Leaderboard. No other method of entry will be accepted.
4. Prize Description: The winner of the GateGuru leaderboard on a National level (“Grand Prize Winner”) will receive 2 round trip tickets on JetBlue. The winner in each region (“Regional Winner”) is based on aggregated points within relevant airports (“Included Airports”) and will receive $100 JetBlue travel certificates. Regions included in the Contest include: New York City (Included Airports: JFK, LGA, EWR), Boston (Included Airports: BOS, MHT, BDL), Florida (Included Airports: MIA, FLL, MCO, TPA, RSW, JAX, PBI), California (Included Airports: LAX, BUR, LBG, ONT, SFO, OAK, SJC, SAN, SNA, SMF) and Chicago (Included Airports: ORD, MDW). Points earned outside or across Included Airports will count towards the National leaderboard only. Users cannot win more than one prize. In the event that a person has the most points across multiple leaderboards, that user will win one prize, and the prize in the other area will go to the person in position #2 (assuming that user has not won in a different area).
5. Prize Notification: Prize will be notified via email and must have a signed up to GateGuru with a valid email address. Upon being notified, prize winners must evidence appropriate eligibility requirements.
6. GateGuru shall retain the full responsibility over the monitoring and maintenance of the High Flyers Points. In its sole discretion, GateGuru shall have the right to award or subtract High Flyer Points at any time or from time to time as it sees fit. GateGuru shall be the sole authority in determining the winner of the prizes and such discretion shall not be subject to challenge.
7. Prizes are not redeemable in cash and must be accepted as awarded, with no substitutions. GateGuru reserves the right to revise, amend, or modify the prize, make substitutions of equivalent kind or approximate value in our sole discretion for any reason whatsoever.
8. By entering the Contest, the entrant authorizes the use, without additional compensation, of his or her name and/or likeness and/or voice/photograph and municipality of residence for promotion and/or advertising purposes in any manner and in any medium (including without limitation, radio broadcasts, newspapers and other publications and in television or film releases, slides, videotape, distribution over the internet and picture data storage) which GateGuru may deem appropriate.
9. In accepting the prize, the winner hereby releases GateGuru and JetBlue and their respective employees and affiliates, from and against any loss, damages, warranty, costs, injury or other claims incurred as a result of the Contest, including, but not limited to, usage of the prizes. All prizes are being offered “as is” with no warranty or guarantee either express or implied by neither GateGuru nor JetBlue.
10. This contest is subject to all federal, state and municipal laws.
11. GateGuru reserves the right to withdraw or terminate this contest at any time without prior notice.
12. Approximate value of prizes varies.
13. The prize winner must agree to JetBlue’s legal policies located at www.jetblue.com/about/legal/legal.asp. Travel certificates are subject to availability, blackout dates, and/or change due to circumstances beyond GateGuru’s control. No extensions will be permitted, and any unused travel will be forfeited. Prizes cannot be used in conjunction with any other promotion or offer and may not be separated and must be accepted as awarded, substitution, including cash equivalent, is not available. All tickets issued in conjunction with the prize are not eligible for TrueBlue points, and no code-share flights may be used. Winner is responsible for any taxes, fees, and service charges, and surcharges applicable to the air travel prize, including but not limited to Passenger Facility Charges of up to $9.00 each way, September 11th Security Fees of up to $5.00 each way, Federal Segment Taxes of $3.50 per domestic segment (a segment is a takeoff and landing), and international government fees and taxes of up to $127.60 each way.
14. Prize winner is solely responsible for additional costs not explicitly included as part of the prize description, including any taxes and/or fees that may be incurred (beyond those listed immediately above), such as income tax liability, if any. Winner is required to provide GateGuru with proper and legal picture identification and Social Security number within 30 days of notification of winning the prize. Winner may forfeit any and all winnings if verification cannot or has not been made within 30 days. Upon proper verification, winnings will be awarded directly by GateGuru.
15. Prizes do not constitute property of the winner and are non-transferable. Prizes may not be sold, bartered, or otherwise exchanged for value. Any prize that is purchased, sold, bartered, or otherwise exchanged for value is void. Violators (including any individual who uses a purchased or bartered award) may be liable for damages and litigation costs, including the actual cost of travel and/or GateGuru and JetBlue’s attorneys’ fees and costs incurred in enforcing this rule.
16. Any disputes in connection with the Contest or these Rules shall be governed by New York law, exclusive of New York choice of law rules, and the winner agrees to the exclusive jurisdiction of the New York, state and federal courts, to resolve any dispute in connection with Contest or these Rules.
17. GateGuru is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. GateGuru is not responsible for theft or destruction or unauthorized access to or alterations of Contest materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. GateGuru is not responsible for inaccurate transmissions of or failure to display Contest materials on account of technical problems or traffic congestion on the internet or at any website or any combination thereof.
18. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY INDEMNIFY AND DEFEND GATEGURU AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE RULES INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE RULES BY YOU. IN THE EVENT GATEGURU IS SUBJECT TO LIABILITY PURSUANT TO THE CONTEST, SUCH LIABILITY SHALL BE LIMITED TO THE VALUE OF THE PRIZE.
